Description
This appeal raises the sole question of whether a person committed to a county jail or a county reforestation camp as a condition of probation is entitled to good time under sec. 53.43, Stats. Eugene Prue was convicted on March 15, 1973, under sec. 943.20 (1) (d), Stats., on his plea of guilty of obtaining money under false pretenses. He was sentenced to the Wisconsin State Prison for an indeterminate term of not more than two years. The execution of the sentence was stayed and he was placed on probation for one year with the condition he would spend the first six months of the period in the Brown county reforestation camp. On March 27, 1973, Prue moved for a modification of his sentence to eliminate therefrom the words "with no good time given." This motion was denied and Prue now brings writs of error to review the judgment of sentence and the order denying his motion.
